Terms and Conditions for Firearms Sales (Texas Based with Local Pickup).

Welcome to our website. By using this platform, you agree to comply with these Terms and Conditions, the laws of the State of Texas, and all applicable US federal regulations.

1. Governing Law and Jurisdiction

Texas Jurisdiction: These terms are governed by and construed in accordance with the laws of the State of Texas.
Venue: Any legal action or dispute arising from this website must be filed in a court located in Texas.

2. Inventory and Direct Sales Only

Direct Inventory: We sell only our own direct inventory.
No Consignments: We do not offer or accept consignment listings from third parties.
No Trade-Ins: We do not accept trades, trade-ins, or partial swaps for any items.
Used Condition: All firearms are sold in used condition.
Media Accuracy: We provide detailed photos and descriptions of all cosmetic wear and mechanical status.

3. Pricing, Texas Sales Tax, and Payments

Currency: All prices are listed in USD.
Texas Sales Tax: Orders shipped to a Texas address or picked up locally are subject to 8.25% sales tax.
Fully Paid Online: All purchases must be paid in full online at checkout before any shipment or local pickup can occur.
Cash on Pickup: We only accept cash, checks, or in-person payments at our physical location if you purchase the firearm directly at the store.

4. Local Pickup Requirements

Appointment Only: Local pickup is available strictly by scheduled appointment at our store at 3990A Barker Cypress Rd, Houston, TX 77084.
Background Check: You must complete and pass the ATF Form 4473 background check on-site before taking possession of the firearm.
Identification: You must present a valid, unexpired Texas government-issued photo ID with your current physical address.
Pickup Window: Paid items must be picked up within 14 calendar days of your order confirmation.
Abandoned Orders: Firearms left past 14 days without prior written approval face order cancellation and a 25% restocking fee.

5. Federal Law and FFL Transfer Shipping

No Direct Shipping: Shipped firearms are never sent directly to individuals or residential addresses.
FFL Delivery: Shipped orders must go to a federally licensed dealer holding a valid Federal Firearms License (FFL).
Dealer Fees: The buyer pays all transfer fees charged by their receiving FFL dealer independently.
Documentation: The receiving FFL must email a copy of their license before we ship the firearm.

6. Buyer Eligibility and Legal Compliance

Age Limits: You must be 21 or older to buy handguns, receivers, or frames.
Rifle Age: You must be 18 or older to buy long guns or rifles.
Prohibited Persons: You certify that you are not legally barred from owning a firearm under 18 U.S.C. § 922(g).
Straw Purchases: Ordering a firearm on behalf of another person is illegal and strictly prohibited.

7. Shipping Restrictions and Local Laws

State Bans: We do not ship firearms, magazines, or parts that violate your local state laws.
Know Your Laws: It is the buyer's absolute responsibility to check local restrictions before placing an order.
USA Only: We ship exclusively to addresses within the United States. We do not ship internationally.

8. Safety Disclaimer and Inspection Window

As-Is Sales: All firearms are sold 'As-Is'; with no mechanical or functional warranties.
Safety Inspection: You must have a certified gunsmith inspect any used firearm before firing it.
Liability: We are not liable for injury or damage resulting from the use or misuse of sold items.
On-Site Pickup Inspection: Local pickup buyers must inspect the firearm thoroughly before signing the ATF transfer paperwork.
Final Sale: Once the FFL transfer is completed (either on-site or at your receiving FFL), the sale is final.
Failed Background Check: If you fail your background check (on-site or at your receiving FFL), the order will be refunded minus a 20% restocking fee and any applicable shipping costs.
